Welcome to www.eviction-center.com (the “Site”), owned and operated by The Eviction Center (“Eviction Center,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and any services, forms, documents, or communications provided by Eviction Center (collectively, the “Services”). By accessing or using the Site or engaging our Services, you (“you,” “User,” or “Client”) agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.

1. Description of Services

Eviction Center assists property owners, rental housing professionals, and their authorized agents in completing the unlawful detainer (eviction) process, including but not limited to notice preparation and service, court filings, document preparation, and coordination of the lockout process with the applicable Sheriff’s or Marshal’s department. Services may cover residential, commercial, mobile home, recreational vehicle (RV), and postforeclosure evictions. Eviction Center works with independent, licensed attorneys who may be engaged separately for contested matters, relief from bankruptcy stay motions, or other litigation. Any attorney engagement is a separate arrangement between you and the attorney and is not automatically included in Eviction Center’s non-attorney services.

2. Unlawful Detainer Assistant Disclosure (California)

Eviction Center is a registered and bonded Unlawful Detainer Assistant (“UDA”) operating under California law. Please note the following required disclosures:

  • We are not attorneys and cannot provide legal advice. We cannot tell you what your legal rights or strategies are, represent you in court, or select legal forms for you in a way that requires legal judgment.
  • Registration Number: UDA-000006
  • County of Registration: Riverside
  • If you have a complaint about our services as a UDA, you may contact the county clerk’s office where we are registered.

Any UDA services are limited to typing, preparing, and filing legal documents at your specific direction, and providing general procedural information about the eviction process. If you need legal advice specific to your situation, you should consult a licensed attorney.

3. No Attorney-Client Relationship; Not Legal Advice

Use of the Site, submission of an inquiry, or engagement of non-attorney Services does not create an attorney-client relationship between you and Eviction Center or any attorney associated with Eviction Center, unless and until a separate, signed engagement agreement is executed directly with that attorney. Content on the Site — including the “Process,” “Resources,” “Posts,” and similar pages — is provided for general informational purposes only, reflects general California landlordtenant procedures at the time of publication, is not legal advice, and may not reflect current law or the specific rules of the court in your jurisdiction. Laws and local court rules change, and you should confirm current requirements before relying on any information on this Site.

4. Eligibility and Account Use

You must be at least 18 years old and have the legal authority to act on behalf of the property owner (or be the property owner) to use our Services. You agree to provide accurate, current, and complete information when requesting Services and to promptly update that information as needed.

5. Fees and Payment

Fees for Services will be quoted separately based on the type of eviction, county, and scope of work requested. Court filing fees, service of process fees, Sheriff/Marshal lockout fees, and similar third-party costs are separate from and in addition to Eviction Center’s service fees, unless otherwise stated in writing. Payment terms, refund eligibility, and cancellation policies will be set out in your service agreement or invoice. Fees are generally non-refundable once work has been performed or filings have been submitted, except as required by law or as otherwise agreed in writing.

6. No Guarantee of Outcome or Timeline

The eviction process involves court proceedings, third-party agencies (including the Sheriff’s or Marshal’s department), and actions by opposing parties (including tenants), all of which are outside our control. Eviction Center does not guarantee any particular outcome, court ruling, timeline, or result. Estimated timeframes provided on the Site or by our staff are approximate and may change based on court schedules, tenant responses, contested filings, bankruptcy stays, or other factors.

7. Client Responsibilities

You are responsible for: (a) providing accurate and truthful information regarding the tenancy and property; (b) complying with all applicable federal, state, and local landlordtenant laws, including fair housing laws; (c) timely responding to requests for information or signatures; and (d) understanding that Eviction Center acts only on the specific instructions you provide for document preparation and filing.

8. Testimonials

Testimonials and “Success Stories” published on the Site reflect the individual experiences of specific clients and are not a guarantee, warranty, or prediction regarding the outcome of your matter. Results vary based on the facts and circumstances of each case.

9. Third-Party Links and Resources

The Site may link to third-party websites, organizations (such as apartment associations or industry groups), or resources for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any third-party site. Inclusion of a link does not imply endorsement.

10. Intellectual Property

All content on the Site — including text, graphics, logos, images, and forms created by Eviction Center — is owned by or licensed to Eviction Center and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission, except for your personal use in connection with your own eviction matter.

11. Prohibited Uses

You agree not to: use the Site for any unlawful purpose; misrepresent your identity or authority over a property; attempt to interfere with the security or functionality of the Site; or use any automated means to scrape or extract content from the Site without permission.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INFORMATION ON THE SITE IS CURRENT OR ACCURATE FOR YOUR SPECIFIC SITUATION OR JURISDICTION.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVICTION CENTER, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, RENTAL INCOME, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID TO EVICTION CENTER FOR THE SPECIFIC MATTER GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability where such limitation is prohibited by law, including certain protections afforded to consumers under California’s Unlawful Detainer Assistant statutes.

14. Indemnification

You agree to indemnify and hold harmless Eviction Center, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) inaccurate information you provided; or (c) your violation of any law or third-party right in connection with your use of the Services.

15. Confidentiality and Privacy

We handle information you provide in connection with your eviction matter in accordance with our Privacy Policy. Note that information provided to a UDA is not protected by attorney-client privilege unless separately communicated to a retained attorney.

16. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflictof-law principles. Any dispute arising from these Terms or the Services shall be brought exclusively in the state or federal courts located in Riverside County, California.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
